How Ontario Land Transfer Tax works

Every buyer in Ontario pays a graduated Land Transfer Tax at closing. It's paid to the province by your real estate lawyer out of your closing funds — you don't send a separate cheque. The rate steps up in brackets, so only the portion of the price inside each bracket is taxed at that rate.

The first-time buyer rebate

If you qualify as a first-time home buyer, Ontario gives you up to $4,000 back on your provincial LTT. On homes priced at $368,000 or less, that fully cancels the tax. On everything above, you still get the full $4,000 knocked off. Your lawyer applies it automatically at closing — tell them early that you're a first-time buyer.

Buying in Toronto? You get a second, separate rebate of up to $4,475 against the municipal LTT. In Durham Region (Whitby, Ajax, Pickering, Oshawa, Clarington) there is no municipal LTT to begin with — one of the quietest reasons Durham keeps attracting Toronto buyers.

Ontario LTT is graduated: 0.5% on the first $55,000, 1.0% up to $250,000, 1.5% up to $400,000, 2.0% up to $2,000,000, and 2.5% above that. It's paid at closing by your real estate lawyer.

How much is the first-time home buyer LTT rebate in Ontario?

Up to $4,000 off your Ontario Land Transfer Tax. Homes priced at $368,000 or less pay no provincial LTT at all. If you're buying in Toronto, you also qualify for a second municipal rebate of up to $4,475.

Do I pay Land Transfer Tax on a new build?

Yes. LTT applies to new builds the same way as resale. The tax is calculated on the total purchase price (including HST if it's baked in) and paid at final closing.

Does Durham Region have a municipal Land Transfer Tax?

No. Only the City of Toronto charges a municipal LTT on top of the provincial one. Whitby, Ajax, Pickering, Oshawa, and Clarington buyers pay only the Ontario LTT — a real savings versus buying in Toronto.

Who qualifies as a first-time home buyer in Ontario?

You must be 18+, a Canadian citizen or permanent resident, have never owned a home anywhere in the world, and your spouse must not have owned a home while married to you. You also have to occupy the home as your principal residence within 9 months of closing.
